County sends letters requesting business not use access drive
WARREN — The Trumbull County Prosecutor’s Office has sent letters to a local businessman and a Texas-based company requesting they stop using a county-owned access drive off McMullen Street in Brookfield to get onto his property.
Assistant Prosecutor William J. Danso wrote to Joseph Hray, his associates and others that the majority of the commissioners voted Aug. 14 that Hray cease using the nonpublic access road to get onto his property. Commissioners Niki Frenchko and Mauro Cantalamessa voted to send letters to Hray, as well as Select Water Solutions LLC in Gainesville, Texas, and Cleveland to stop trespassing on county property.
“This parcel of Trumbull County property is not held open to the public, but is used by Trumbull County and its agents to access utility installations and for the construction of a new radio tower,” Danso wrote in the letter. “Please discontinue use of this private property immediately.”
In a separate letter sent to Select Water Solutions LLC, Danso acknowledged the company may be seeking to access a privately-owned injection well named Hray-Mullenax Disposal located on an adjoining property to the access drive.
The letters sent to Hray and Select Water Solutions were sent Aug. 16, two days after the commissioners meeting.
Commission President Denny Malloy last week voted against sending the cease and desist letter, stating Hray and one former commissioner each noted there was an easement document that allowed Hray to access the drive.
Malloy wanted to give Hray, as well as members of the county’s staff, time to find the written documents.
As of Tuesday afternoon, no documents have been located to substantiate those claims.
Frenchko said the letters needed to be sent to protect a county-owned water tower and a MARCS radio tower being built on county-owned property.
Hray said once he receives the letter, he will honor the request.
